Welcome to HAMgpt ("HAMgpt", "we", "us"). HAMgpt is a personal amateur‑radio assistant available at hamgpt.co. By creating an account or using HAMgpt, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

1. What HAMgpt is

HAMgpt helps licensed and prospective amateur‑radio operators by answering questions and suggesting on‑air activity, personalized to the information you provide (license class, location, station). It combines live amateur‑radio data with AI‑generated assistance.

2. Amateur‑radio disclaimer — read this

HAMgpt is an informational aid, not an authority. Answers — including any frequencies, band plans, sub‑band edges, power limits, tones, offsets, or license privileges — may be incomplete, out of date, or wrong, and AI‑generated content can contain errors.

  • Always verify any operating parameter against official sources (e.g. the current FCC Part 97 rules, the ARRL band plan, your license, and your equipment manuals) before you transmit.
  • You alone are responsible for operating legally and safely within your own license privileges and local regulations.
  • HAMgpt is not a substitute for studying for and holding the appropriate license, and must not be relied upon for safety‑critical or emergency decisions.

Building, installing, and operating equipment is at your own risk. Antennas, towers, feedlines, electrical work, and RF energy involve real hazards — electric shock, RF exposure, falls, structural failure, fire, and lightning. Any dimensions, designs, calculations, or instructions HAMgpt provides are general information only and may be incomplete or wrong. You are solely responsible for how you use or implement any information — including verifying it, following manufacturer instructions and applicable codes, and using qualified professionals (such as a licensed electrician or structural engineer) where appropriate. We are not responsible for any injury, death, property damage, or other loss — to you or to any third party — arising from your use or implementation of the service or its output, including building, installing, or operating any equipment.

3. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent where you live) to use HAMgpt. You are responsible for activity under your account and for keeping your sign‑in secure. We use a managed authentication provider and "Sign in with Google" for sign‑in; your use of Google sign‑in is also subject to Google's terms.

4. Acceptable use

Don't use HAMgpt to: break the law or amateur‑radio regulations; harass, harm, or impersonate others; attempt to disrupt, reverse‑engineer, scrape, or overload the service; or generate content that is unlawful. We may suspend or terminate accounts that abuse the service.

5. AI‑generated content

Responses are generated with the help of third‑party AI providers and may be inaccurate. You are responsible for evaluating and verifying any output before acting on it. See Section 2.

6. Intellectual property

HAMgpt, its branding, and its software are owned by us or our licensors. We grant you a personal, non‑exclusive, non‑transferable right to use the service. You retain rights to the content you submit; you grant us a limited license to host and process it to operate and improve HAMgpt. We do not use your content — and our third‑party AI providers do not use it — to train general‑purpose or commercial AI models (such as Gemini or Claude). We may analyze it internally to improve HAMgpt's own answers, features, and knowledge base.

7. Service availability & changes

HAMgpt is provided on an "as available" basis. We may change, suspend, or discontinue features at any time. This is an early‑stage product and may contain bugs.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON‑INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMGPT AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON THE SERVICE OR ANY OUTPUT, FROM ANY LOSS, CORRUPTION, OR DELETION OF DATA, OR FROM ANY REGULATORY VIOLATION, INTERFERENCE, INJURY, OR PROPERTY DAMAGE RESULTING FROM OPERATING, BUILDING, OR INSTALLING YOUR STATION. Nothing limits liability that cannot be limited by law.

Liability cap. To the maximum extent permitted by law, our total liability for any and all claims relating to the service will not exceed the amount you paid us in the one‑month period immediately before the event giving rise to the claim (which may be zero if you use HAMgpt for free).

10. Termination

You may stop using HAMgpt and request deletion of your account at any time (see the Privacy Policy). We may suspend or terminate access for violations of these Terms.

11. Changes to these Terms

We may update these Terms; material changes will be reflected by the "Last updated" date above. Continued use after a change means you accept the revised Terms.

12. Subscriptions & billing

Some features may require a paid subscription. Prices and what each plan includes are shown before you subscribe. Subscriptions renew automatically each billing period until you cancel; you can cancel anytime from your account, and cancellation takes effect at the end of the current period. Payments are processed by Stripe, our payment processor — we never see or store your full card number. Except where required by law, fees already paid are non‑refundable. We may change prices or plans with notice; a change never affects a period you've already paid for.

13. Your data and backups

HAMgpt is not a backup or storage service. You are responsible for keeping your own copies of any data you value — including the original of any logbook (ADIF) file you upload and your station details. We do not guarantee that your data will be available, retained, or preserved for any length of time, and we are not liable for any loss, corruption, or deletion of your data, however caused — including storage limits, technical failure, accidental deletion, account inactivity, or because the data relates to a paid feature your plan no longer includes. In particular, if you move to a plan that does not include personalized station data, we may stop retaining and may delete your logbook and station details. Keep your own copy before changing or canceling your plan.

14. Indemnification

You agree to defend, indemnify, and hold harmless HAMgpt and its operator from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use or misuse of the service, your violation of these Terms or of any law or amateur‑radio regulation, your content, or how you build, install, or operate any equipment — including claims brought by third parties.

15. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict‑of‑laws rules.

16. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us about the service and supersede any prior agreements. You may not assign these Terms; we may assign them to a successor (for example, in a merger or sale). Our failure to enforce a provision is not a waiver of it.
